Saratoga County Justice invalidates unconstitutional absentee ballot canvassing law

 

BUFFALO — Erie County Republican Committee Chairman Michael Kracker released the following statement on yesterday’s major victory for election integrity in Saratoga County Supreme Court:

“New York State Supreme Court Justice Rebecca Slezak’s decision yesterday to throw out the 2021 absentee canvassing law as unconstitutional should be cheered by every New Yorker who believes in free, fair, and honest elections.

The law in question removed judicial oversight and supervision of the absentee ballot canvassing process, a process that served New Yorkers well for generations. The law that was passed in 2021 removed the ability of nonpartisan, nonpolitical members of the judiciary to order an invalid absentee ballot to not be counted. Yesterday’s decision restores the judiciary’s role in ensuring that all legal absentee ballots — and only legal
absentee ballots — are counted.

Additionally, I’m proud to say that the Erie County Republican played an important role in this victory. The Erie County Republican Lawyers Club filed a friend-of-the-court brief authored by ECGOP Party Counsel Joe Burns in support of invalidating this unconstitutional law. We’re glad we could support this effort and look forward to working with our colleagues at the New York Republican State Committee, Republican National Committee, and National Republican Congressional Committee in the future to defend the integrity of our electoral system.”
